$1,000 PRIZE DRAW PROMOTION

 Terms and Conditions

  1. The promoter of the $1,000 Prize Draw Promotion ("the Competition") is Australian Property Alliance Pty Ltd (APA) (ACN 102 889 896) ("the Promoter").
  2. The Competition begins on 01 January 2011 and ends on 01 June 2012 at 11.59pm (Australian Western Daylight Saving Time) ("the Competition Period").
  3. An individual who enters the Competition ("Entrant") must send in their entry so that it is received by the Promoter during the Competition Period.
  4. An Entrant must not submit more than one entry.
  5. An Entrant must be over 18 years of age.
  6. This document, the instructions on how to enter the Competition and other details contained within promotional advertisements and on the website www.nicheliving.com.au each form part of the terms and conditions.  It is each Entrant's responsibility to ensure their entry is received by the Promoter before the end of the Competition Period.
  7. The Promoter reserves the right to either allow or disallow any Entrant for any reason it sees fit in its absolute discretion.
  8. The Promoter accepts no responsibility for late, lost or misdirected entries.
  9. Entry to the Competition is not open to:
  • employees of APA;
  • any adult child, parent, grandparent, grandchild, sibling or spouse of an employee of APA;
  • any promotional agents (including their spouses) of APA.
  1. Up to one Entrant ("Winner") may be awarded the prize ("Prize") as follows: $1,000 cash.
  2. The Winner shall be chosen by the Promoter from the entries at random.
  3. The monthly draw will take place at Australian Property Alliance on the last Friday of each month.  The Winner will be notified by email and their details posted on www.nicheliving.com.au.
  4. When the Winner is notified of their Prize, the Winner will also be provided with details as to the collection of their Prize.
  5. When the Prize is collected by the Winner, identification, which includes a photograph, will be required.  The collection of the Prize is the sole responsibility of the Winner.  The Prize will only be awarded following Winner validation and verification.
  6. The Promoter's decision is final and no correspondence will be entered into.
  7. In the event that the Winner fails to satisfy any of the terms and conditions of the Competition, that Winner shall not be entitled to the Prize and the Promoter may in its discretion disqualify the Winner and award the Prize to another Entrant in accordance with the terms and conditions or choose not to award the Prize.  The Winner is disqualified from the Competition and forgoes the Prize if the Winner’s entry is misleading or if the Winner does not adhere to the terms and conditions.
  8. A Prize must be taken as stated and is non-transferable and non-exchangeable.  If the specified prize becomes unavailable for any reason, the Promoter may substitute a prize of like or equal value.  Any tax payable as a result of a prize being awarded or received will be the Winner's responsibility.
  9. The Promoter reserves the right to add to or waive any of these terms and conditions.
  10. The Promoter takes no responsibility for the loss of prizes due to incorrect or imprecise delivery details provided by a Winner.  The Promoter makes no representations or warranties as to the quality, suitability or merchantability of any of the goods or services offered as Prizes.  To the extent permitted by law, the Promoter is not liable for any loss including, but not limited to, personal injury, loss or damage suffered or sustained to personal property including, but not limited to, consequential (including economic) loss for any reason including, but not limited to, by reason of any act or omission deliberate or negligent by the Promoter or its servants or agents in connection with the Competition or the Prize.
  11. The Promoter and its related entities, employees, contractors, servants or agents shall not be liable for and accept no responsibility for any accident, loss, injury or damage to any individual or property arising out of or in conjunction with the Competition or the Prize either during or after the Competition except for any liability which cannot be excluded by law.
  12. The Promoter is not responsible for lost, interrupted communications or unavailable network server or other connections, failed telephone, mid-delivery or computer transmissions or other errors of any kind, whether human, mechanical or electronic.
  13. The Promoter assumes no responsibility for any error, defect, delay, theft or unauthorised access to or alteration of entries.  Subject to any written directions given under the applicable law, if for any reason the Competition is not capable of operating as planned, including infection by computer viruses, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness or proper conduct of the Competition, then the Promoter reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Competition insofar as is permitted by law.  The Promoter reserves the right, in its sole discretion, to disqualify any Entrant for:
  • tampering with the entry process, including exceeding any limitation on the numbers of entries, or any other process as determined by the Promoter that in any way affects the fairness of the promotion;
  • tampering with the operation of the Competition or the website www.nicheliving.com.au;
  • acting in violation of the terms and conditions; or
  • acting in an unsportsmanlike or disruptive manner.
  1. Participation in the Competition constitutes the Entrant's unconditional agreement to and acceptance of the terms and conditions.  The Entrant is responsible for ensuring his or her familiarity with the terms and conditions.  The Promoter's decision not to enforce a specific term or condition does not constitute a waiver of that term or condition or of the terms and conditions generally.
  2. All entries remain the property of the Promoter and may be entered into a database for future marketing or promotional activities.
  3. The Entrant, in the event that they are a Winner, consents to the publishing of their name and suburb of residence on the internet website www.nicheliving.com.au.  Acceptance of a Prize by the Winner constitutes permission for the Promoter to use the Winner's name and suburb of residence, and recording of the Winner's voice and likeness for advertising and promotional purposes without compensation, unless otherwise prohibited by law.  The Promoter will not use Entrant's personal information for any purpose other than that stated in these terms and conditions without their consent unless required or authorised to do so by law.  An Entrant must notify the Promoter in writing if they would like to amend their personal information or if they have any queries as to how their personal information will be used.
  4. The Competition is subject to the Promoter's Privacy Policy.
  5. The Competition is only open to residents of Western Australia.

 


LUXURY HONEYMOON PACKAGE WITH EVERY NICHELIVING HOME [return to top]

Terms and Conditions

  1. 1. The promoter of the Luxury honeymoon package with every Nicheliving home (“the Offer”) is made by Australian Property Alliance Pty Ltd t/a Nicheliving Real Estate (ACN 102 889 896) ("the Agent on behalf of the Seller").
  2. This Offer applies to purchasers ("Purchaser") over the age of 18 years of selected house and land packages as set out in the Official Price List and as referred to on the website www.nicheliving.com.au ("the house and land packages").  The Official Price List is available from the Seller upon request.
  3. The house and land packages must be purchased between 15 April 2012 and 30 June 2012 and settlement with respect to the house and land packages must occur prior to 30 July 2012.
  4. The offer is for a 5-star luxury honeymoon package to Phuket at the Indigo Pearl Resort including return airfares for two adults only. Dates of travel are from: 25th of April to the 24th of June 2012; 11th of July to the 22nd of September 2012; and 8th of October to the 31st of October 2012.
  5. Travel conditions are as follows:
    (a) Travel is permitted outside of these dates for an additional surcharge.
    (b) Flights and accommodation are subject to availability at the time of travel.
    (c) Packages must be booked no later than the 30th of September 2012. Where bookings can't be made until after the 30th of September we reserve the right to amend the package price based off any increase in Thai Airways airfares.
    (d) The maximum retail value of this prize is $3000. In the event that the airline or hotel increases their rates between now and the date of booking any amount over the retail price of $3000 will need to be covered by the Client.
    (e) A minimum of 2 weeks’ notice is required to book packages. The more notice that can be provided the better the chances are of the requested dates being available.
    (f) Package includes Flights, Accommodation, Breakfast Daily & Private Transfers. Travel Insurance is not included. It is the travellers responsibility to have a valid Passport with a minimum of 6 months validity from the date of return to Australia.
  6. The offer must be taken as stated and is non-transferable and non-exchangeable.  If the specified offer becomes unavailable for any reason, the Promoter may substitute the offer of like or equal value.  Any tax payable as a result of the offer being awarded or received will be the Client's responsibility.
  7. The Offer is not open to:
    (a) employees of the Seller;
    (b) any adult child, parent, grandparent, grandchild, sibling or spouse of an employee of the Seller;
    (c) any promotional agents (including their spouses) of the Seller.
  8. If the Offer applies, then the honeymoon package will be available if the Purchaser complies with the following:
    (a) the Purchaser complies with these terms and conditions;
    (b) the Purchaser pays the deposit referred to in the contract of sale with respect to the house and land package by the date referred to in that contract of sale; and
    (c) the Purchaser settles on the contract of sale with respect to the house and land package on the due date referred to in that contract of sale but in any event settlement must occur on or before 30 June 2012.
  9. Should a Purchaser who has been offered the honeymoon package fail for any reason to proceed with the purchase of the house and land package, then that person will not be entitled to receive the honeymoon package or to take advantage of the Offer.
  10. The honeymoon package will be provided pursuant to the Offer and will be ordered from the supplier when the Seller has ascertained and verified that clauses 7, 8 and 9 above have been complied with to the Seller's satisfaction. Availability of the honeymoon package will be dependent on the airline, resort and the travel agency. The agent will not be held liable for any delays as a result of this or any factors beyond our control.
  11. This document and any other details contained within promotional advertisements of the Seller, its agent Australian Property Alliance (APA) t/a Nicheliving Real Estate or on the websites www.nicheliving.com.au and www.facebook.com/apaniche each form part of the terms and conditions with respect to the Offer.
  12. The Seller reserves the right to either allow or disallow a Purchaser's entitlement to the honeymoon package for any reason it sees fit in its absolute discretion to the full extent permitted by law.
  13. The Seller's decision as to whether the Offer is available on a particular house and land package is final.  The Seller reserves the right not to include the Offer in a house and land package in its absolute discretion.
  14. In the event that a Purchaser fails to satisfy any of the terms and conditions, that Purchaser will not be entitled to take advantage of the Offer and the Seller may at its discretion offer the honeymoon package to another Purchaser in accordance with these terms and conditions or choose not to offer the honeymoon package to any person.
  15. The honeymoon package must be taken as stated and is non-transferable, non-exchangeable and not redeemable for cash.  If the honeymoon package becomes unavailable for any reason, the Seller may substitute the honeymoon package with another item of equal value.  Any tax payable as a result of receiving the honeymoon package or an item substituted for the honeymoon package or accepting the Offer is the Purchaser's responsibility.
  16. When the honeymoon package is collected by the Purchaser, identification which includes a photograph will be required.
  17. The Seller and its related entities, employees, contractors, servants or agents take no responsibility for any injury, loss or damage in any circumstances whatsoever.  The Seller makes no representations or warranties as to the quality, suitability or merchantability of any goods or services offered.  To the extent permitted by law, the Seller is not liable for any loss suffered or sustained to personal property including but not limited to consequential and economic loss for any reason, including but not limited to, by reason of any act or omission deliberate or negligent by the Seller, its servants or agents in connection with this Offer.
  18. The Seller reserves the right to disqualify a person to whom the honeymoon package has been offered from the Offer and entitlement to the honeymoon package if that person has breached any of the terms and conditions or if that person has misled or deceived the Seller in any way.
  19. The Seller reserves the right to:
    (a) add to or waive any of these terms and conditions;
    (b) cancel the Offer or any part of it at any stage in the event of circumstances beyond the Seller's control; and
    (c) declare as void any claims for the honeymoon package resulting from any printing, production or distribution errors,
    to the extent permitted by law.
  20. The Seller and its related entities, employees, contractors, servants or agents shall not be liable for and accept no responsibility for any accident, loss, injury or damage to any individual or property arising out of or in conjunction with the Offer at any time now or in the future except for any liability which cannot be excluded by law.
  21. Acceptance of the Offer constitutes a Purchaser's unconditional agreement to and acceptance of these terms and conditions.  The Seller’s decision not to enforce a specific term or condition does not constitute a waiver of that term or condition or of the terms and conditions generally.
  22. By accepting the Offer, a Purchaser consents to the publishing of their name and suburb of residence on the Seller's and/or its agent APA's websites including www.nicheliving.com.au and www.facebook.com/apaniche and consents to the Seller using the Purchaser's name and suburb of residence and recording of voice and likeness for advertising and promotional purposes without compensation unless otherwise prohibited by law.
  23. This Offer is subject to the Seller's and its agent APA's Privacy Policy and the Seller and its agent APA agree that they will not use any person's personal information for any other purpose without their consent unless required or authorised to do so by law.
  24. This offer is only open to residents of Western Australia.

Terms and Conditions

  1. This promoter of the 1 in 5 chance to win a boat promotion (“the Offer”) is made by Australian Property Alliance Pty Ltd t/a Nicheliving Real Estate (ACN 102 889 896) ("the Agent on behalf of the Seller").
  2. This Offer applies to purchasers ("Purchaser") over the age of 18 years of selected house and land packages lhttp://squid.globaliq.com.au/squid/ocated at Nicheliving Port Geographe as set out in the Official Price List with respect to house and land packages in relation to Nicheliving Port Geographe and as referred to on the website www.nicheliving.com.au ("the house and land packages").  The Official Price List is available from the Seller upon request.
  3. The house and land packages must be purchased between 17 February 2012 and 30 May 2012 and settlement with respect to the house and land packages must occur prior to 30 June 2012.
  4. If a Purchaser is more than one individual, the Purchaser must nominate an individual over the age of 18 years to take advantage of the Offer.  Only one Boat is available per Purchaser notwithstanding that the Purchaser may be two or more individuals or a corporation.
  5. The agent will not be held liable for any delays as a result of this.

Terms and Conditions

  1. The promoter of the Fly and Buy with NicheQ (“the Offer”) is made by Australian Property Alliance Pty Ltd t/a Nicheliving Real Estate (ACN 102 889 896) ("the Agent on behalf of the Seller"). 
  2. This Offer applies to purchasers ("Purchaser") over the age of 18 years of selected house and land packages at NicheQ Broome North as set out in the Official Price List and as referred to on the website www.nicheliving.com.au ("the house and land packages").  The Official Price List is available from the Seller upon request. 
  3. The house and land packages must be purchased between 26 April 2012 and 30 June 2012 and settlement with respect to the house and land packages must occur prior to 30 July 2012. 
  4. The offer is for economy return airfares and accommodation up to 3 nights at a local hotel for two adults only to a maximum cost of AUD$2,000 inc GST for travel between 26 April 2012 to 30 June 2012. Travel Insurance is not included. Any tax payable as a result of the offer being awarded or received will be the Client's responsibility.
  5. The Offer is not open to:
    1. employees of the Seller;
    2. any adult child, parent, grandparent, grandchild, sibling or spouse of an employee of the Seller;
    3. any promotional agents (including their spouses) of the Seller.
  6. If the Offer applies, then the Fly and Buy promotion will be available if the Purchaser complies with the following:
    1. the Purchaser complies with these terms and conditions;
    2. the Purchaser pays the deposit referred to in the contract of sale with respect to the house and land package by the date referred to in that contract of sale; and
    3. the Purchaser settles on the contract of sale with respect to the house and land package on the due date referred to in that contract of sale but in any event settlement must occur on or before 30 July 2012.
  7. Should a Purchaser who has been offered the Fly and Buy promotion fail for any reason to proceed with the purchase of the house and land package, then that person will not be entitled to receive the Fly and Buy promotion or to take advantage of the Offer.

Terms and Conditions

  1. The promoter of the Two storeys for the price of one promotion ("the Promotion") is Australian Property Alliance Pty Ltd t/a Nicheliving Real Estate (ACN 102 889 896) ("the Promoter").
  2. This Offer applies to Buyers ("Buyer") over the age of 18 years of selected house and land packages located at Nicheliving Kwinana, Piara Waters, and West Swan as set out in the Official Price List, and as referred to on the website www.nicheliving.com.au ("the house and land packages").  The Official Price List is available from the Seller upon request.
  3. The house and land package must be purchased between 04 May 2012 and 30 June 2012 and settlement with respect to the house and land packages must occur upon issue of titles and/or prior to 30 December 2012.
  4. The Promotion is subject to the Promoter's Privacy Policy.
