EXTENDING = FIRST HOME OWNERS' GRANT (FHOG) PROMOTION =

($7,000.00= BONUS ON TOP OF GOVERNMENT $14,000 FHOG AS AT 1st Oct= ober 2009)

 

Terms and Conditions

 

1.&n= bsp;      This Offer is made by South Development Alli= ance Pty Ltd (ACN 107 989 319) care of PO Box 51, Northbridge WA 6865 ("the Seller"). As well as other companies Si= lver Development Alliance Pty Ltd (ACN 124 198 732), Langford Development Alliance Pty Ltd (ACN 123 = 843 621) and Bluegum Development Alliance Pty Ltd (= ACN 128 007 321).

2.&n= bsp;      This Offer applies to Buyers ("Buyer&qu= ot;) over the age of 18 years for house and land packages located at The Niche <= span class=3DSpellE>Kelmscott, Langford, Beechboro and Ballajura as set out in the Official Price = List with respect to house and land packages in relation to The Niche Kelmscott, Langford, Beechboro and Ballajura and as referred to on the website www.nicheliving.com.au ("the house and land packages"). The Offic= ial Price List is available from the Seller upon request.

3.&n= bsp;      The house and land packages must be purchased between 1 September 2009 and 31 October 2009 and settlement with respect to= the house and land packages must occur prior to 30 December 2009.

4.&n= bsp;      The offer ("Offer") is a bonus in = the form of a discount of $7,000.00 upon Settlement of the Contract entered into between the Buyer and the Seller subject to subclause<= /span> 6.

5.&n= bsp;      Only one bonus of $7,000.00 is available for each Buyer notwithstanding that the Buyer may be two or more individuals. <= /p>

6.&n= bsp;      If the Offer applies, then the $7,000.00 bon= us will be available if the Buyer is eligible for the first home owners grant = and boost in the total sum of $14,000.00 and the Buyer complies with the follow= ing:

(a)&= nbsp;   the Buyer complies with these terms and conditions;

(b)&= nbsp;  the Buyer pays the deposit referred to in the Contract between the Buyer and the Seller ("the Contract of Sale") with respect to the house and land package by the date referred to in the Contract; and

(c)&= nbsp;   the Buyer settles= on the Contract on the due date referred to in the Contract or on or before 30 December 2009 whichever is the later.

7.&n= bsp;      Should a Buyer who has been offered a $7,000= .00 bonus fail for any reason to proceed with the purchase of the house and land package, then that Buyer will not be entitled to receive the $7,000.00 bonu= s or to take advantage of the Offer.

8.&n= bsp;      The $7,000.00 bonus will be provided pursuan= t to the Offer and will be available as a discount at Settlement of the Contract once the Seller has ascertained and verified that clauses 5, 6 and 7 above = have been complied with to the Seller's satisfaction.

9.&n= bsp;      This document and any other details containe= d within promotional advertisements of the Seller, its agent APA or on the websites www.apagroup.com.au and www.nicheliving.com.au each form part of the terms = and conditions with respect to the Offer.

10.&= nbsp;  The Seller reserves the right to either allo= w or disallow a Buyer's entitlement to the Offer for any reason it sees fit in i= ts absolute discretion to the full extent permitted by law.

11.&= nbsp;  The Seller's decision as to whether the Offe= r is available on a particular house and land package is final. The Seller reser= ves the right not to include the Offer in a house and land package in its absolute discretion.

12.&= nbsp;  In the event that a Buyer fails to satisfy a= ny of the terms and conditions, that Buyer will not be entitled to take advant= age of the Offer or receive the $7,000.00 bonus and the Seller may at its discretion offer the $7,000.00 bonus to any another Buyer in accordance with these terms and conditions or choose not to offer the $7,000.00 bonus to any person.

13.&= nbsp;  The Seller reserves the right to disqualify a person to whom the $7,000.00 bonus has been offered from the Offer and entitlement to the $7,000.00 bonus if that person has breached any of the t= erms and conditions or if that person has misled or deceived the Seller in any w= ay.

14.&= nbsp;  The Seller reserves the right to:

(a)&= nbsp;   add to or waive any of these terms and conditions;

(b)&= nbsp;  cancel the Offer or any part of it at any st= age in the event of circumstances beyond the Seller's control; and

(c)&= nbsp;   declare as void a= ny claims for the $7,000.00 bonus resulting from any printing, production or distribution errors, to the extent permitted by law.

15.&= nbsp;  Acceptance of the Offer constitutes a Buyer's unconditional agreement to and acceptance of these terms and conditions. The Seller's decision not to enforce a specific term or condition does not constitute a waiver of that term or condition or of the terms and conditions generally.

16.&= nbsp;  This Offer is subject to the Seller's and its agent Australian Property Alliance (APA)'s Privacy Policy and the Seller and its agent APA agree that they will not use any person's personal information for any other purpose without their consent unless required or authorised to do so by law.
