SUPPLIERS AND SUB-CONTRACTORS
TERMS & CONDITIONS 

1. The Supplier agrees that this order received is deemed to be at the correct rates unless notifying the appropriate personnel within 72 hours of order received.

2. Agreed Orders are to be invoiced exactly as per the agreed order, failure will result in rejected invoice.

3. The Supplier on acceptance of this order will undertake the works as described on this order and the terms and conditions which are available for viewing on request.

4. The Supplier will not charge the Builder any additional costs other than the amount stated on the order.

5. The Supplier must procure and maintain at its own expense: workers compensation insurance, employer’s liability insurance, public liability insurance. A copy of these certificates must be received by this office before any payments are made.

6. The Supplier must provide, before commencement of work on site, all required documentation in relation to Occupational, Safety and Health requirements.

7. The Supplier must clean up after their work and dispose of rubbish appropriately: failure to do so will result in a reduction of payment to enable the Builder to employ another contractor to carry out this work.

8. If the Builder believes that the Supplier will not complete works within a reasonable amount of time, the Builder will have the right at his sole discretion to cancel this order and recover any remedial cost to complete the works

7. APA reserves the right to change these terms and conditions at any time by posting changes online. You are responsible for regularly reviewing information posted by us online to obtain timely notice of such changes. Your continued use of this website after changes are posted constitutes your acceptance of these terms and conditions as modified by the posted changes.

NICHELIVING'S RENT TO OWN
 
  1. The information provided in these terms and conditions are intended to assist a prospective buyer understand the key terms and procedures associated with purchasing a home through the Nicheliving rent-to-own scheme. It includes a summary of some of the features of the residential tenancy agreement and the contract of sale and some of the provisions of the documents used to effect the rent-to-own scheme.
  2. To be approved for the Nicheliving rent-to-own scheme, the prospective buyer must complete an application, qualify and be approved. 16. If a provision of these Terms and Conditions is invalid, illegal or unenforceable, then to the extent of that invalidity, illegality or unenforceability, that provision is severed from these Terms and Conditions and all other provisions remain in full force and effect.

LITTLE TO NO SAVINGS PROMOTION

TERMS AND CONDITIONS

NO STAMP DUTY PROMOTION
TERMS AND CONDITIONS

The following terms and conditions are issued by Australian Property Alliance Pty Ltd (Nicheliving) and apply to the Stamp Duty promotion being offered by Nicheliving (Promotion):
  1. This Promotion commences on 22 January 2020 and ends on 22 April 2020 (or such other date determined by Nicheliving in its absolute discretion) (Promotion Period).
  2. This Promotion applies in respect of contracts entered into during the Promotion Period (Eligible Contract) for the sale and purchase of the following categories of Nicheliving properties:
    1. Nicheliving off-the-plan apartments for a new residential unit or apartment in a multi-tiered structure (being a vertical development other than a single-tier strata scheme as defined by section 3(1) of the Strata Titles Act 1985 ) (Off-the-plan Apartment); and
    2. selected Nicheliving home and land packages as determined in Nicheliving’s absolute discretion as a property to which this Promotion applies and as confirmed in writing by Nicheliving to the buyer at the date of entry into an Eligible Contract (Home and Land), 
(each an Eligible Property).
  1. This Promotion is available to the buyer of an Eligible Property under an Eligible Contract (Eligible Buyer).
  2. If the Eligible Buyer is a foreign person as defined by section 205A of the Duties Act 2008, then the Promotion excludes Home and Land.
  3. The Promotion contemplates Nicheliving discounting the value of any Eligible Property under an Eligible Contract by an amount determined by reference to the transfer duty that would have been payable on the Eligible Contract based on the purchase price of the Eligible Property prior to any deduction made under this Promotion (Applicable Transfer Duty).
  4. Subject to the Maximum Discount, Nicheliving will, in respect of any Eligible Contract entered into for any Eligible Property by an Eligible Buyer, discount the purchase price of the Eligible Property by an amount equal to:
    1. 100% of the value of the Applicable Transfer Duty where the Eligible Property is an Off-the-plan Apartment and Nicheliving determines that the Eligible Buyer would not otherwise be eligible for an off-the-plan duty rebate offered by the Office of State Revenue in Western Australia; or
    2. in all other cases, 25% of the value of the Applicable Transfer Duty.
  5. The maximum discount that Nicheliving will apply to any Eligible Property on account of the value of Applicable Transfer Duty is $10,000 (Maximum Discount).
  6. This Promotion does not apply in conjunction with any other offer made by Nicheliving or its related bodies corporate.
  7. This Promotion is not open to employees of Nicheliving or its related bodies corporate, or any member of their immediate family.
