Terms and Conditions of “We’ll Pay Your Rent” (Promotion)
1.1. Promotion: We’ll Pay Your Rent
1.2. Promotor: Australian Property Alliance Pty Ltd (ACN 102 889 896) of 180 Newcastle Street, PERTH WA 6000 (Promotor), a subsidiary of Nicheliving Holdings Limited (NLH)
1.3. Promotion Period: The Promotion commences on 10th May 2021 and ends on 30th June 2021 as amended at the Promotor’s absolute discretion (Promotion Period).
1.4. Benefit Period: The period commencing on entering the Agreement and concluding on the Property Settlement (Benefit Period).
2.1. None of the Promotor, NLH or any of their related bodies corporate, directors, officers, employees, contractors or consultants give or purport to give financial advice or investment advice, including in respect of whether to participate in the Promotion.
2.2. No account has been taken of the objectives, financial situation or needs of any recipient of these terms and conditions (T&Cs). Recipients of these T&Cs should carefully consider whether an investment in property (including by way of participation in the Promotion) is an appropriate investment for them in light of their personal circumstances, including their financial and taxation position.
2.3. The information provided in these T&Cs is not and should not be regarded as legal, financial or other professional advice. Eligible Applicants should at all times obtain independent advice.
2.4. These T&Cs are subject to change.
3.1. The Promotion is open to persons that:
- are residents of Western Australia;
- are at least 18 years of age;
- are a tenant in a private residential property;
- are a party to a binding arm’s length residential tenancy agreement with an unrelated third party landlord (satisfied in the Promotor’s sole discretion) with a fixed-term that continues for six months or longer (Tenancy Agreement);
- have not varied their Tenancy Agreement in the four weeks before applying to enter the Promotion;
- have a bond lodged with the Bond Administrator (if required under the Residential Tenancies Act 1987 or Residential Parks (Long-stay Tenants) Act 2006); and
- is otherwise determined by the Promotor as eligible to participate in the Promotion in its absolute discretion,
3.2. If requested by the Promotor (or its nominee), the Eligible Applicant must provide evidence to the Promotor’s (or its nominee’s) complete and absolute satisfaction to confirm the Eligible Applicant meets the eligibility requirements set out under clause 1.
3.3. An Eligible Applicant may only participate in the Promotion after the Promotor (or its nominee) is completely satisfied the Eligible Applicant meets each eligibility requirement set out under clause 1.
3.4. Eligible Applicants enter the Promotion on these T&Cs.
3.5. The Promotor, in its absolute discretion, may change the eligibility criteria at any time during the Promotion Period and subsequently, an Eligible Applicant’s eligibility in the Promotion may change prior to the expiry of the Promotion Period.
4. How to participate in the Promotion
4.1. To participate in the Promotion, an Eligible Applicant must, during the Promotion Period:
a) enter into an agreement to purchase an eligible property (Agreement). At the commencement of the Promotion Period, eligible properties include selected properties at:
- Nicheliving Maddington, East Cannington, Orelia, Tapping, Willetton, Viveash (a Property)
and exclude properties at:
- Applecross (High End), Inglewood (Sky Homes), East Cannington (Apartments);
b) complete the sale and purchase of a Property in accordance with the Agreement (Property Settlement); and
c) provide evidence to Nicheliving that it has made rental payments under the Tenancy Agreement during the Benefit Period equal to the Benefit offered by this Promotion.
4.2. The Promotor, in its absolute discretion, may change the participation criteria at any time during the Promotion Period and subsequently, an Eligible Applicant’s eligibility for the Promotion may change prior to the expiry of the Promotion Period.
5. Benefit under the Promotion
5.1. Provided the Eligible Applicant has satisfied the participation criteria in clause 1, the Promotion will facilitate the Eligible Applicant receiving as a participant in the Promotion up to a maximum value of:
a) $20,000 towards the value of rental payments made by the Eligible Applicant in accordance with their Tenancy Agreement during the Benefit Period, if the Eligible Applicant entered into an Agreement to purchase a Property in the following Nicheliving developments:
- Nedlands, Cottesloe, Dalkeith; or
b) $10,000 towards the value of rental payments made by the Eligible Applicant in accordance with their Tenancy Agreement during the Benefit Period, if the Eligible Applicant entered into an Agreement to purchase a Property in the following Nicheliving developments:
- Nicheliving Maddington, East Cannington, Orelia, Tapping, Willetton and Viveash
5.1. Any applicable Benefit under clause 1, will be provided to the Eligible Applicant upon the Property Settlement as an adjustment to and deduction from the purchase price payable on the relevant Property and will be provided in accordance with these T&Cs.
5.3. Any applicable Benefit under clause 1, may not be converted into cash or any other form of tender.
5.4. Only one Promotion may be applied to anyone Property.
5.5. No Benefit is transferable.
5.6. This Promotion does not take account of transfer duty payable on purchase or applicable transaction or settlement costs.
6. Eligible Applicant Warranties
6.1. The Eligible Applicant warrants:
a) they are a resident of Western Australia;
b) they are at least 18 years of age;
c) they are a tenant in a private residential property;
d) they are a party to a binding arm’s length residential tenancy agreement with an unrelated third party landlord (satisfied in the Promotor’s sole discretion) with a fixed-term that continues for six months or longer;
e) they have not varied their Tenancy Agreement in the four weeks before applying to enter the Promotion; and
f) they have a bond lodged with the Bond Administrator (if required under the Residential Tenancies Act 1987 or Residential Parks (Long-stay Tenants) Act 2006).
7. General Conditions
7.1. Each Eligible Applicant agrees to be bound by these T&Cs.
7.2. Without effecting the validity of any Benefit, the Promotor may terminate this Promotion at any time without further notice to Eligible Applicants.
7.3. If there is any inconsistency between these T&Cs and any other information published by the Promotor or the Nicheliving group, these T&Cs will prevail to the extent of the inconsistency.
7.4. This Promotion and the provision of a Benefit is not transferable.
7.5. The Promoter may collect personal information about you for the purposes of the Promotion which will be maintained in accordance with applicable law.
7.6. This Promotion does not apply in conjunction with any other offer made by NLH or its related bodies corporate.
7.7. This Promotion is not open to employees of NLH or its related bodies corporate, or any member of their immediate family.
7.8. The terms of NLH’s or its related bodies corporate Privacy Policies apply to this Promotion.
7.9. These terms are governed by the laws of Western Australia.
7.10 The Promoter, NLH, their related bodies corporate, directors, officers, employees, contractors or consultants disclaim all liability for any loss or damage which is suffered or sustained by an Eligible Applicant or any third party arising out of or in connection with the Promotion.
