NICHELIVING’S GRANT GUARANTEE
1. Promotion
1.1. Promotion: Nicheliving’s Grants Guaranteed campaign
1.2. Promotor: [Australian Property Alliance Pty Ltd (ACN 102 889 896) of 180 Newcastle Street, PERTH WA 6000] (Promoter), a subsidiary of Nicheliving Holdings Limited (NLH)
1.3. Promotion Period: The Promotion commences on 2 October 2020 and ends on 31 August 2020 as amended at the Promoter’s absolute discretion (Promotion Period). Promotion offer is valid for eligible applicants from promotion commencement date only and only selected Nicheliving home and land packages and apartments.

2.1. None of the Promoter, NLH or any of their related bodies corporate, directors, officers, employees, contractors or consultants give or purport to give financial advice or investment advice, including in respect of whether to participate in the Promotion.
2.2. Grants guaranteed for Nicheliving selected locations only and some locations don’t apply.
2.3. No account has been taken of the objectives, financial situation or needs of any recipient of these terms and conditions (T&Cs). Recipients of these T&Cs should carefully consider whether an investment in property (including by way of participation in the Promotion) is an appropriate investment for them in light of their personal circumstances, including their financial and taxation position.

3. Eligibility
3.1. The Promotion is open to persons that are residents of Western Australia and at least 18 years of age or as otherwise determined by the Promoter in its absolute discretion (Eligible Applicant).
3.2. Eligible Applicants enter the Promotion on these T&Cs.
3.3 Eligible Applicants to receive the full $80,000 of support must meet the below criteria:
With all selection criteria above being met, this would present a total amount of $80,000 of support on the basis the successful applicant meets all Federal, State and Nicheliving selection criteria to be eligible for the support of $80,000.
4. How to participate in the Promotion
To participate in this Promotion, an Eligible Applicant must, during the Promotion Period:
(a) enter into an agreement to purchase an eligible property (a Property), as determined by the Promotor in its absolute discretion (Agreement); and
(b) complete on the purchase and settlement of a Property (Settlement).
(c) meet all Federal and State government selection criteria as mentioned in 3.3 eligibility criteria.
5. Benefits under the Promotion
5.1. The Promotion facilitates each Eligible Applicant receiving as a participant in the Promotion and for nil consideration the below top of support to a total maximum value of $10,000:
(a) subject to clause 5.3, a financial incentive equal to the value the Eligible Applicant personally pays in rent, however, not exceeding a total amount of $11,000, for the period between the date the Eligible Applicant enters into the Agreement and the date Settlement occurs but no longer than 12 months total period. Offer only applies on selected house and land packages and not apartments and commence upon payment of first progress claim and paid from further claims thereafter as a rebate. Proof of existing rental agreement must be provided.
(b) financial incentive, equal to the stamp duty payable on the sales contract for the Property, payable either as a cash payment or rebated against the balance of the purchase price (at the Promoter’s election) on Settlement. Offer available to eligible home applicants. Noting where there is government assistance and the applicant does not have to pay stamp duty – the promoter will not pay again as there is no stamp duty required. In the instance where a second home buyer or investor has to pay the stamp duty only off the plan apartments will be eligible for this offer; if the applicant receives government assistance for off the plan property such as a 75% rebate – the offer will only be limited to the remaining required balance of stamp duty in this example being 25% and not the total amount of stamp duty due to only a 25% fee would be required from the applicant,
(c) subject to clause 5.5, a financial incentive equal to the value the Eligible Applicant pays in mortgage for the first twelve months from Settlement, not exceeding a total of $11,000 payable at settlement as a discount or rebate,
(each, a Benefit, collectively the Benefits).
5.2. The maximum value an Eligible Applicant participating in the Promotion can receive collectively from the Benefits is $11,000 in aggregate.
5.3. To receive the Benefit under clause 5.1(a), the Eligible Applicant must:
(a) reside in a property in Australia and pay rent on that property under a residential tenancy agreement; and
(b) prior to Settlement, satisfy the Promotor, in the Promotor’s absolute discretion, of the existence of the relevant residential tenancy agreement and the amount the Eligible Applicant will personally pay under that residential tenancy agreement from the date of the sales contract until Settlement.
(c) meet all Federal and State government selection criteria as mentioned in 3.3 eligibility criteria.
5.4. Failure to satisfy the Promotor under clause 5.3(b) will result in no Benefit rendered under clause 5.1(a).
5.5. To receive the Benefit under clause 5.1(c), the Eligible Applicant must satisfy the Promotor, in the Promotor’s absolute discretion, that the Eligible Applicant is the borrower under an approved mortgage agreement entered into for the sole purpose of funding the Property.
5.6. Failure to satisfy the Promotor under clause 5.5 will result in no Benefit being conferred under clause 5.1(c).
5.7 Any applicable Benefits under clause 5.1, will be provided to the Eligible Applicant at Settlement through an adjustment of the purchase price payable on the relevant Property and will be provided in accordance with these T&Cs.
5.8. The Benefits may not be converted into cash or any other form of tender.
5.9. Only one Nicheliving Campaign/Promotion may be applied to anyone Property.
5.10. The Benefits are not transferable.
5.11. Grants guaranteed for selected Nicheliving locations
6. General Conditions
6.1. Each Eligible Applicant agrees to be bound by these T&Cs.
6.2. Without affecting the validity of any Benefits as at the date of termination, the Promotor may terminate this Promotion at any time without further notice to Eligible Applicants.
6.3. If there is any inconsistency between these T&Cs and any other published information in relation to the Promotion, these T&Cs will prevail to the extent of the inconsistency.
6.4. This Promotion and the provision of the Benefits are not transferable.
6.5. An Eligible Applicant may only enter this Promotion once.
6.6. All entries become the property of the Promoter. The Promoter may collect personal information about you for the purposes of the Promotion which will be maintained in accordance with applicable law.
6.7. This Promotion does not apply in conjunction with any other offer made by NLH or its related bodies corporate.
6.8. This Promotion is not open to employees of NLH or its related bodies corporate, or any member of their immediate family.
6.9. The terms of NLH’s or its related bodies corporate Privacy Policies apply to this Promotion.
6.10. These terms are governed by the laws of Western Australia.
6.11. The Promoter, NLH, their related bodies corporate, directors, officers, employees, contractors or consultants disclaim all liability for any loss or damage which is suffered or sustained by an Eligible Applicant or any third party arising out of or in connection with the Promotion.
